1.INTRODUCTION & REGISTRATION

1.1 You are required to register as a susbcriber in order to use the Service by providing, amongst others, your full name (as appeared in your NRIC/passport), mobile phone number, email address and correspondence address. You are also required to provide your online shop URL (website, Facebook page, Instagram page and/or e-commerce page) if applicable.

1.2 You agree to: (a) provide true, accurate and complete information for registration purposes; (b) maintain and promptly update such registration information to keep it accurate, current and complete; and (c) you shall not use another subscriber’s account without permission. If you provide any information that is untrue, inaccurate or incomplete, or if SMGB suspects that any information provided by you is untrue, inaccurate or incomplete, SMGB reserves the absolute right to suspend or terminate your subscription and refuse any and all current or future use of the Programme and/or Service.

1.3 As a registered subscriber, you will receive access to content and features on the Programme which includes but not limited to: -

a) Monthly newsletter on baking tips and products promotion made available by advertisers of SMGB
b) Exclusive baking classes
c) Social media baking contest
d) Exclusive entrepreneur courses on making baking a career

1.4 You are not able to access the Programme and/or Service without registration.

1.5 By subscribing to the Program, you shall not:

a) select or use a third party’s name and/or any personal particulars of a third party; or
b) use a name which SMGB deems offensive, vulgar or obscene.

1.6 SMGB reserves the absolute right to reject registration of, or cancel an account without prior notice. Cause for such rejection/cancellation shall include but not limited to:

a. SMGB believes in good faith that your usage of the Programme and/or Service violates any of the terms contained herein or that your usage is alleged to infringe any intellectual property; or
b. You impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity; or
c. You interfere with or disrupt the Service or another person's use of the Service.

1.7 The subscription is personal to you and cannot be shared or transferred to any third party.

1.8 You should be mindful of any communication requesting your personal or other account information. You hereby acknowledge that providing information in response to these types of communications can result in identity theft.

2. USE AND DISCLOSURE OF PERSONALLY IDENTIFIABLE INFORMATION AND ANONYMOUS INFORMATION

2.1 You hereby expressly consent to the collection, disclosure and use of your Personal Data (as defined by Section 4 of the Personal Data Protection Act 2010) by SMGB, its subsidiaries, affiliates and/or business partners.

3. WARRANTIES AND LIMITATIONS OF LIABILITY

3.1 The Programme and Service are provided to you on an "as is where is" basis and without warranty or condition. In particular, the Programme and/or Service may not be uninterrupted or error-free. You waive all special, direct/indirect and consequential damages against SMGB in relation to your use of the Programme and/or Service.

3.2 SMGB and its sponsors, content providers and advertisers hereby expressly exclude all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity and shall not be liable for any damages whatsoever, including but without limitation to any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, damage to goodwill or reputation, or the cost of procurement of substitute goods and services, arising out of or related to the use, inability to use, performance or failures of the Programme and/or Service and any usage of the product or materials posted thereon, irrespective of whether such damages were foreseeable or arise in contract, tort, equity, restitution, by statute, at common law or otherwise.

3.3 You agree to indemnify and keep SMGB and its directors, officers, employees, agents and affiliates harmless from any and all third party claims, liability, damages and/or costs (including but not limited to, legal fees) arising from your use of the Programme and/or Service.

4.1 The Programme may contain links to third party sites (collectively, "Third Party Sites"). You use and/or access these Third Party Sites at your own risk. SMGB does not monitor or has any control over, and makes no claim or representation regarding these Third Party Sites. SMGB provides these links as a convenience only, and a link to a Third-Party Site does not imply SMGB’s endorsement, adoption or sponsorship of, or affiliation with, such Third-Party Sites.

4.2 SMGB shall not be held responsible for any of these Third Party Sites or their content.

4.3 SMGB does not allow unauthorized hypertext links to these Third Party Sites.

5.TERMINATION OF ACCOUNT

5.1 SMGB may terminate your subscription and/or access to the Programme and/or Service at any time, with or without cause. You may terminate your subscription at any time by unsubscribing to the newsletter by clicking on the unsubscribe tab at the footer of the newsletter and/or email. provided that such termination shall not affect or prejudice SMGB’s rights which have accrued prior to the date of termination nor shall it affect the coming into force or the continuance in force of any provision hereof which is expressly or by implication intended to come into or continue to be in force on or after termination.

6.AMENDMENT

6.1 SMGB reserves the absolute right to amend any of the terms stated herein from time to time. SMGB may amend any and/or all aspects of the Service provided through the Programme at any time without prior written notice. Any amendments to these Terms and Conditions will be uploaded here and therefore, you are encouraged to check/visit here from time to time.

6.2 Your continuing usage and/or access to the Programme and/or Service following such amendment constitutes your acceptance of these terms as amended.

7. INVALIDITY

7.1 If any of the terms stated herein is unenforceable (including any exclusion of SMGB’s liability), the enforceability of the remaining parts of these Terms and Conditions will not be affected.

8. GOVERNING LAW

8.1 These Terms and Conditions shall be governed by the laws of Malaysia and you agree that any dispute or claim arising out of the use of and access to the Programme and/or Service will be adjudicated in the courts of Malaysia.
